FREIGHT & TRANSPORT POLICY
All sales are quoted on an F.O.B. Bethlehem, PA basis unless otherwise specified. The customer selects a freight carrier, and materials are shipped on a freight collect basis. All carriers selected by customers must be insured with an appropriate amount of public liability and other insurances as required by law. In addition, all drivers employed by carriers must have in their possession a current hazardous materials endorsement attached to their commercial drivers license and a current copy of the U.S. Department of Transportation's Emergency Response Guidebook. All drivers are required to sign a release at the time of pick up indicating that they and their employer are in compliance with the above requirements. For those customers who have not negotiated competitive rates with carriers, Puritan can offer discounted prepaid freight via select house carriers to any location in North America. In these situations, freight charges will be added to the invoice for merchandise as an itemized line item.
CLAIMS POLICY
Claims for all damaged shipments should be made directly with the carrier. Please inspect all goods carefully
at the time of receipt so that all damage may be noted on the freight bill. Puritan Customer Service will
assist in the filing of claims with carriers of prepaid and add shipments.
PRICING POLICY
Published pricing is subject to change without notice. Quotations on materials other than those that are published are considered firm for sixty (60) days unless otherwise specified in writing.
SPECIFICATIONS POLICY
Product specifications are subject to change without notice if the change is directed by an industry-accepted guideline.
SALES TAX
All qualified orders may be subject to sales, use or other taxes in effect at the time of sale.
TERMS OF SALE
Prior to doing business with Puritan, a New Customer Questionnaire, Credit Application, and Sales Tax Exemption Form must be completely filled out and returned for evaluation. Export terms are negotiable, but typically require payment in advance of order. For customers not paying in advance, invoices are payable in net 30 days. A one (1) percent discount may be offered if invoice payment is received by Puritan Products within ten (10) days. Any invoice that remains unpaid beyond thirty (30) days from date of invoicing may be subject to a one and one half (1.5) percent per month service charge.
MINIMUM ORDER POLICY
A minimum order of $ 250.00 is required. Any order not meeting this minimum may be subject to a processing and handling fee equivalent to the difference between the minimum charge and the actual amount of the invoice.
RETURNED MERCHANDISE POLICY
Authorization from Puritan Products is required prior to any return of previously purchased merchandise. Customer must obtain a Returned Merchandise Authorization Number before initiating a return. If such authorization is not granted, any returned shipment may be refused and shipped back to customer at the customer's expense.
Any product that does not comply with established Puritan Products specifications, that has been shipped to the customer in error, or has been recalled by Puritan Products will be accepted for full credit and at Puritan's freight expense provided it is returned within ninety (90) days from the date of shipment, or notice of recall, whichever may be the case. All such returns, with the exception of specific packages sampled for evaluation, must be made in the original unopened containers with labels intact, and inner and/or outer packaging free from damage and/or extraneous markings.
Puritan Products shall have the right to require samples of any subject material be forwarded to Puritan's Quality Assurance Laboratory prior to issuing customer a Returned Merchandise Authorization Number.
The return of merchandise may be considered for reasons other than previously mentioned. Under no condition, however, will merchandise be authorized for return or accepted at Puritan's docks if any one or more of the following conditions exist:
- The customer does not prepay the freight.
- Merchandise is not in its original unopened container with labels intact, and inner and/or outer packaging free from damage and/or extraneous markings.
- Merchandise has deteriorated due to shelf life being exceeded, or due to circumstances involving improper storage, heat, cold, moisture etc.
- At least 1 (one) year has passed since the date the material shipped.
- Materials and/or packages have been discontinued.
- Merchandise has been damaged in transportation. The carrier is responsible for this damage. (Please see Puritan's Claims Policy).
- Merchandise is custom manufactured specifically for an individual customer's needs (unless material does not meet Puritan's previously established specifications).
- Total value of merchandise is less than $250.
All merchandise authorized for return to Puritan Products must be shipped in accordance with all current United States Department of Transportation C.F.R. 49 regulations.
A credit will be issued for returned merchandise less a twenty-five (25) percent restocking charge. Credit is issued only after receipt and inspection of returned goods.
ORDER CANCELLATION POLICY
All finished goods must be accepted as ordered by the customer. Exceptions to this rule are noted in this paragraph. Unless an order is completed or a work in progress prior, a customer has 24 hours from the time of order placement, within which time period, order cancellations may be made without penalty. If a customer cancels an order for goods or services after the 24 hour period from receipt of the order, then Puritan Products reserves the right to issue an invoice for the goods or services with the mutual understanding that the invoice must be paid in full. Puritan's customer will also be responsible for any disposal costs that may be incurred if the subject goods must be removed from our facility. This cancellation policy applies specifically to non-stock, custom manufactured, or custom service related items and/or to goods that would result in creating inventory above normal stocking levels.
CUSTOMER PICK-UP POLICY
For customers requesting orders to be picked up by the carrier of their choice, assuming the material is in stock, they should provide a minimum of twenty-four (24) hours notice from the time the order is placed until the scheduled time of pick-up. For all custom or special orders, customers must specify a mutually acceptable pick-up date at the time of order placement and confirm this date within twenty-four (24) hours prior to the expected pick-up. Merchandise for customer pick-ups shall be available after 12:30 PM unless otherwise specified by Puritan's Customer Service Department. If customer needs to deviate from the originally scheduled pick-up date and/or time, it is requested that this be confirmed with the Customer Service Department. Load locks for securing merchandise for transport in any carrier vehicle are required with all pick-ups. If the customer carrier does not have load locks in their possession, and has no other acceptable means of securing the freight, Puritan will provide load locks at a cost of $50.00 each. Typically this fee is collected directly from the carrier at the time of loading; however, it remains the sole discretion of Puritan to invoice the customer for this equipment.
PALLET POLICY
Items are packaged in unitized pallets to insure the integrity of the product during shipping. Unless specifically noted, material is shipped on pallets. A charge of $10.00 per pallet will be added to the invoice as a separate line item.

WARRANTY
Puritan Products materials are warranted to conform to the specifications appearing in the current published specification sheets for a period of two (2) years from the date of sale. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PURITAN PRODUCTS EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, WHETHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. EXCEPT AS EXPRESSLY SET FORTH HEREIN, THE PRODUCT IS PROVIDED "AS-IS." ALL WARRANTIES AND CONDITIONS SHALL TERMINATE TWO (2) YEARS FROM DATE OF SALE.
EXCLUSIVE REMEDY
EXCEPT AS OTHERWISE PROVIDED HEREIN, YOUR EXCLUSIVE REMEDY AND PURITAN PRODUCTS ENTIRE LIABILITY ARISING FROM OR IN CONNECTION WITH THE PRODUCT, AND/OR THIS AGREEMENT (INCLUDING WITHOUT LIMITATION FOR BREACH OF WARRANTY, CONDITION, OR NON-INFRINGEMENT) SHALL BE REPLACEMENT OF THE PRODUCT OR REFUND OF THE PURCHASE PRICE FOR THE PRODUCT AT THE OPTION OF PURITAN PRODUCTS.
LIMITATION OF LIABILITY
IN NO EVENT WILL PURITAN PRODUCTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PRODUCT OR THE BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR OTHERWISE IN CONNECTION WITH THE PRODUCT. IN NO EVENT SHALL PURITAN PRODUCTS TOTAL LIABILITY FOR ANY DAMAGES, DIRECT OR INDIRECT, IN CONNECTION WITH THE PRODUCT EXCEED THE PURCHASE PRICE OF THE PRODUCT, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT OR OTHERWISE.

Puritan Products reserves the right to change its policies, terms and conditions without formal or advanced notice.
